Terms and conditions

SUKELDUMISKLUBI LLC, registry code 11407437, address Õnne st 43 Tartu 50106, Estonia (hereinafter Service Provider) and the customer who formalizes the order of shearwater.eu in E-shop and identifies himself / herself by entering his personal data (hereinafter Service User) in the order Usage Agreement (hereinafter Usage Agreement).

1. E-shop
1.1. The Internet shop created by the service provider, through which the sale of products to the Service User is carried out.

2. General provisions
2.1. Terms of Use Agreement apply to the purchase of goods from shearwater.eu online store.
2.2. The Parties shall be guided by the Law of Obligations Act, other laws of the Republic of Estonia and other legal acts and by the Terms of Use when regulating mutual relations.
2.3. The Service Provider has the right to make changes to the offered E-Shop service at any time.
2.4. The Service Provider has the right to unilaterally change the terms of the User Agreement without being obliged to notify the Service User in writing by e-mail.
2.5. The user of the service has the right to download or print the Terms of Use, which ensures the possibility to store and reproduce the respective information on a durable medium.

3. Products and purchase
3.1. The user of the service selects the desired products and then undertakes to enter the required data for the order fulfillment (surname, first name, contact phone, contact e-mail, city, postcode, mode of transportation) and pay for the products via internet bank bank link or invoice transfer.
3.2. The Service User undertakes to provide the correct information necessary for the execution of the order. The Service Provider is not responsible for the non-performance of the order due to incorrect data provided by the Service User or for any consequences arising therefrom.
3.3. The sale takes place and the contract under the law of obligations enters into force when the User of the Service has paid for the order by bank transfer using the bank link in the E-shop or made the transfer on the basis of the invoice issued.
3.4. Products displayed are usually in stock. The availability of the displayed products may change due to technical problems in the warehouse or e-store programs.
3.5. If the product is out of stock, the order cannot be completed. In this case, the e-shop will contact the user and suggest a possible new delivery time, replacement of the product with another product of the same price and quality or return the money to the Service User within 14 days at the latest.
3.6. The product images displayed are illustrative and may differ from the actual product. The service provider will do its best to provide the best and most accurate product description, but the product descriptions in the online store may not be exhaustive and may contain unintentional errors.
3.7.The products offered in the E-shop are sold to both natural and legal persons.
3.8. The service user confirms that he is at least 15 years old.
3.9 SUKELDUMISKLUBI LLC is the chief processor of personal data, and SUKELDUMISKLUBI LLC transfers the personal data necessary for the execution of payments to the payment processor AS Payment Center. ”

You can also choose to pay by credit card through PayPal. We accept VisaCard and MasterCard / EuroCard credit cards. The amount will be deducted from your card in Euros.

4. Prices
4.1. All prices in the E-shop are in euros and include VAT.
4.2. Promotional coupons are distributed and campaigns are organized by the seller all year round, using customer contact email and social media. Promotional coupons can only be used when purchasing from shearwater.eu.
4.3. The service provider has the right to change the displayed prices at any time. If the user has submitted and paid for the order in the E-shop, the Service Provider undertakes to deliver the corresponding products to the user at the prices valid at the time of the order.
4.4. The service provider has the right to waive the performance of the order in case of a technical error, which has caused the product price in the E-shop to be erroneous.

5. Delivery and Delivery Terms
5.1. In Estonia, the goods are delivered to the service user via Omniva or Smartpost parcel terminal. Standard delivery time is up to 2 working days and maximum delivery time is 10 working days.
5.2. By placing an order E-R before 13:00, the products will be delivered to the selected parcel machine the next day (valid for orders within Estonia). During public holidays or a major sales campaign (such as E-sunday), we will do our best to ensure that the products reach you quickly, but please note the waiting time of about a week. If the order is placed after 13:00, we will put the products on the next day and they will arrive the next day.
5.3. When ordering goods for at least 50 €, the transport is free (Estonia).
5.4. Package shipping fee: Sending a parcel to Omniva parcel machine € 2.95 (Estonia) and SmartPOST parcel terminal € 2.59 (Estonia)
5.5. The Client is obliged to check the correctness of the submitted contact data before the order is made in order to avoid delays and misunderstandings in the delivery of products.
5.6. The Service Provider shall not be liable for any delay in the delivery of the Products and for any misunderstandings that have arisen if the delay or misunderstanding is due to inaccuracy or inaccuracy of the information provided by the Customer upon placing the order.

6. Withdrawal from the Contract prior to the Contractor’s performance of the Contract
6.1. If the Service User wishes to withdraw from the User Agreement after the order has been submitted and before the Service Provider has completed the Service Agreement, the Service User undertakes to notify the Service Provider as soon as possible. The message must be sent to the service provider’s email address info@shearwater.eu
The number of the order from which you wish to withdraw and the contact details of the Service User (first name, surname, date of submission of the order, contact phone number) shall be indicated by e-mail.
6.2. If the withdrawal application reaches the Service Provider after the performance of the Service Agreement by the Service Provider, withdrawal from the contract shall take place in accordance with the chapter “Return right” of the User Agreement.
6.3. The Service Provider shall refund the amount paid to the Service User no later than 14 days after receipt of the request for withdrawal.
6.4. The money is transferred to the same bank account where it was received by the Service Provider.
6.5. The service provider has the right to withdraw from the contract or cancel the contract if the stock of ordered goods is exhausted.
6.6. The user of the service is immediately informed of the withdrawal or cancellation of the contract by telephone, e-mail or post. In this case, any prepayments made by the user of the service will be returned to the Service User’s current account immediately, but not later than within 14 days.

7. Right of return and exchange
7.1. The goods purchased from the e-shop are subject to a 14-day right of return.
7.2. The right of withdrawal does not apply if the Buyer is a legal person.
7.3. The returned product must be complete, complete, in its original packaging and unused, ie. the product to be replaced or returned must not be, it must be in its original packaging and all original labels must accompany the product.
7.4. Products can be changed and returned within 14 days of purchase. The product to be returned or exchanged must be brought to the Shearwater.eu bag shop at Õnne st 43 Tartu 50106, Estonia (E-R: 10.00-18.00; L: 10.00-15.00). If you ordered the goods to the parcel terminal, they can be returned free of charge within a week using the parcel return code.
7.5. If the product is used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods or has signs of use or wear, the E-shop has the right to reduce the refund due to the decrease in the value of the goods.
7.6. You must provide a purchase invoice when returning the goods.
7.7. To return the goods, you must submit an application for the withdrawal of the goods.
a) send the completed withdrawal to info@shearwater.eu and then send the goods in the package within 14 days of receipt of the goods “Shearwater.eu at Õnne st 43 Tartu 50106, Estonia”.
7.8. Upon refund, the Service User will be refunded money no later than 14 days after returning the product.
7.9. The money is transferred to the same bank account where it was received by the Service Provider.
7.10. The e-shop has the right to withdraw from the sales transaction and demand the goods from the Buyer if the price of the goods in the e-shop is significantly below the market price of the goods due to error.
7.11. The exchange of goods is a special case of the right of withdrawal, in which the Buyer returns the goods but does not wish to receive the money but to obtain similar goods at the same or higher value instead of the purchased goods. By exchanging goods with a higher value for goods, the monetary difference is covered by the Buyer.
7.12. Purchased goods can be converted in the following ways:
a) To send the completed withdrawal application with the goods in the package not later than within 14 days from the receipt of the goods to the address “Shearwater.eu at Õnne st 43 Tartu 50106, Estonia”, clearly indicating the goods against which the goods are to be changed.

8. Defective goods
8.1. The e-shop is responsible for the non-conformity or defect of the goods sold to the Buyer that existed at the moment of handing over the item and which occurs within two years from the delivery of the goods to the Buyer. Within the first six months of transferring the item to the buyer, it is assumed that
the deficiency was already present at the time of the transfer. Rejecting the corresponding assumption is an obligation of the Webshop.
8.2. If the goods purchased in the e-shop have defects for which the e-shop is responsible, the e-shop will repair or replace the defective goods. If it is not possible to repair or replace the goods, the e-store will return to the Buyer all fees associated with the sales contract.
8.3. Buyer has the right to contact the web store within two months at the latest by sending an e-mail to info@shearwater.eu or by calling +372 501 8161 (E-R 09.00-16.00)
8.4. The Online Shop is not responsible for any defects that have occurred after the goods have been delivered to the Buyer.

9. Complaint Procedure
9.1. Products sold in the e-store are subject to the 2-year term for filing a complaint provided for in § 218 (2) of the LPA.
9.2. The Service Provider shall not be liable for any damage resulting from the unintended use of the ordered products, as well as for delay in delivery, if this is due to circumstances beyond the control of the Service Provider and / or due to force majeure.
9.3. It takes up to three (3) weeks to process shifts and refunds.

10. Responsibility
10.1.The Service Provider shall be liable until the selling price of the Product.
10.2. The user of the service undertakes to use the e-shop service only for the purposes of law and good practice.
10.3. The user of the service is responsible for the maintenance and maintenance of all the data communication systems of the devices that require the use, as well as for any other expenses caused by the use of the e-store service.
10.4. The User of the Service is fully responsible for damages arising from the use of the E-shop in accordance with the Use Agreement Act to the Service Provider, other users of the Service or third parties.

12. Disagreements
12.1. Disagreements shall be resolved in accordance with the legislation in force in the Republic of Estonia.

13. Terms of Use
13.1. The User of the Service is obliged to familiarize himself with the terms and conditions of the User Agreement.
13.2. At the time of ordering, the notice “By continuing you agree to our general and repayment terms” will appear when you place your order and the Service User agrees that you have read and understood the terms and conditions of the User Agreement and agree to the terms and conditions set forth in the User Agreement.
